Canadian Privacy & Anti-Spam Notice (PIPEDA / CASL)

This page supplements the Picaboo Privacy Policy and outlines Picaboo’s obligations and your rights under the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and Canada’s Anti-Spam Legislation (“CASL”). It applies to all users in Canada.

1. Our Privacy Principles (PIPEDA)

Picaboo adheres to the 10 Fair Information Principles in Schedule 1 of PIPEDA:

  1. 1. Accountability – We are responsible for personal information under our control and have designated a Privacy Officer.
  2. 2. Identifying Purposes – We identify the purposes for which information is collected before or at the time of collection.
  3. 3. Consent – We obtain your knowledge and consent, except where exempt (e.g., fraud investigation).
  4. 4. Limiting Collection – We collect only the information necessary for the identified purposes.
  5. 5. Limiting Use, Disclosure & Retention – We do not use or disclose information for purposes other than those for which it was collected, except with your consent or as required by law.
  6. 6. Accuracy – We keep personal information accurate, complete, and up-to-date.
  7. 7. Safeguards – We protect personal information with security safeguards appropriate to its sensitivity.
  8. 8. Openness – We make information about our policies and practices readily available.
  9. 9. Individual Access – Upon request, we inform you of the existence, use, and disclosure of your personal information and provide access to it.
  10. 10. Challenging Compliance – You may address a challenge concerning our compliance with these principles to our Privacy Officer.

2. Your Rights under PIPEDA

Canadian residents have the right to:

  • Access personal information we hold about you.
  • Request Correction of inaccurate or incomplete information.
  • Withdraw Consent (subject to legal or contractual restrictions).
  • Complain to the Office of the Privacy Commissioner of Canada (OPC) about our practices.

We will respond to access or correction requests within 30 days. Requests may be submitted to privacy@picaboo.com or the postal address listed below.

3. Data Transfers & Storage

Picaboo stores personal information on secure servers in the United States. Where data is transferred outside Canada, it is subject to foreign laws and may be accessible to foreign governments. We use contractual and technical safeguards to protect information during cross-border transfers.

4. Canada’s Anti-Spam Legislation (CASL)

4.1. Commercial Electronic Messages (CEMs)

Before sending you marketing emails, texts, or other CEMs, Picaboo will obtain your express consent or rely on a valid form of implied consent (e.g., an existing business relationship).

All CEMs that we send:

  • Identify Picaboo as the sender.
  • Include our contact information (postal address, phone, and/or email).
  • Provide a clear, working unsubscribe mechanism. We honour unsubscribe requests within 10 business days.

4.2. Report Abuse

If you believe you have received unsolicited CEMs from Picaboo, please email support@picaboo.com or use the unsubscribe link provided.
